Peace Officers' Bill of Rights (POBR)

California's Public Safety Officers Procedural Bill of Rights Act provides qualifying public safety officers with procedural protections in connection with certain investigations and disciplinary proceedings. Depending on the circumstances, those protections may address interrogations, representation, notice, punitive action, and administrative appeals.

Skelly Proceedings & Proposed Discipline

When a public employee faces significant discipline, the Skelly process provides an important opportunity to respond before the proposed discipline takes effect. KC Law Group assists first responders in evaluating the allegations and evidence, identifying factual and procedural issues, presenting mitigating or exculpatory evidence, and preparing a meaningful response to proposed discipline.


We approach the Skelly process with an eye toward both the immediate disciplinary decision and any administrative appeal that may follow.

A notice of final discipline does not necessarily end the process. Depending on the employee's rights under applicable law, agency rules, civil service provisions, or a collective bargaining agreement, discipline may be challenged through an administrative appeal, arbitration, civil service proceeding, or personnel commission hearing.
